Who are Registered Migration Agents and who regulates them?
In Australia, individuals who provide migration advice or migration assistance must be registered with the Office of the Migration Agents Registration Authority (Office of the MARA). It is illegal for a person to provide immigration advice or assistance if not registered and dealing with the people in Australia.
A registered migration agent can use their knowledge of migration procedures to offer advice or assistance to a person wishing to obtain a visa to enter or remain in the country. They can also give assistance to people who are nominating or sponsoring prospective visa applicants from overseas.
A registered migration agent (RMA) in Australia can advise on visa requirements, help an applicant lodge a visa application and deal with the Department of Immigration and Border Protection (DIBP) on the behalf of applicant or sponsor.
The Office of the Migration Agents Registration Authority (Office of the MARA) is a discrete office attached to the Department of Immigration and Border Protection. The functions of the Office of the MARA are set out in Section 316 of the Australian Migration Act 1958 (the Act).
The MARA Office commenced operations on 1 July 2009. Key objectives were to ensure that:
(1) Only suitable persons are registered as migration agents, and unsuitable persons are refused registration or re-registration
(2) Registered agents maintain appropriate knowledge to enable them to provide accurate advice to consumers
(3) All complaints about the services of registered, or formerly registered migration agents are appropriately addressed
(4) The Office of the MARA works collaboratively with the department and other bodies such as prosecuting or regulatory authorities to address the activities of agents outside its mandate consumers understand their rights and agents understand their obligations under the regulatory framework.

Who are Education Agents and who regulates them?
Education agents are not regulated by agency however a vast knowledge and experience is a requirement for someone to deal with educational services.
In Australia the educational agents are encouraged to undergo a formal training regarding Australian Educational Services for Overseas Student Act 2000. For registered migration agents, it is not necessary however it is an advantage to have formal accreditation in such legislation.
